Services Provided by the Canadian Embassy in India

There are many rules and procedures people need to follow if they travel to or reside in India. These guidelines are in place to protect Canadian citizens and safeguard Indian laws and their people. The services provided include:

1. Passport 

The Canadian Consulate in India provides a wide range of passport services. Whether you want to renew your document or replace a damaged one, you can contact the organization directly. The services include:

  • Renew adult passport.
  • Apply for a new adult passport.
  • Apply for a minor/child’s passport.
  • Apply for a special or diplomatic passport.
  • Get certified true copies of your passport or travel documents.
  • Change details like name, address, or gender on your passport. 
  • Replace a lost or stolen passport.

The Canadian government recommends contacting the consulate or embassy before applying. They are working at a reduced capacity due to the pandemic and recommend you only apply if you are traveling within 2 weeks. 

All passports need to be renewed before they expire. The validity of the Canadian passport is 15 years. It is best to apply for a renewal at least a year before it is set to expire. 

2. Visa and Immigration Services

Indian nationals wishing to visit or immigrate to Canada must go through the Canadian Consulate General near them. You need to fill out the required form, submit documents, and visit the closest Visa Office to register your biometrics.

Applicants need to book an appointment and carry all of their required documents with them to the appointment. Canadian visa can take anywhere between two to four weeks to process, and sometimes even longer depending on the case. 

For example, if the applicant needs to overcome criminal inadmissibility, they may need to wait longer to get approval.

3. Adoption or Surrogacy 

India has banned commercial surrogacy but Canadian nationals can adopt a child from India. They must comply with the adoption requirements of the country and the requirements of their place of residence in Canada. 

The High Commission of Canada in India can help with the process. Citizens should also get in touch with the CARA or Canadian Adoption Resource Agency to get further assistance. Here’s how the Consulate can help:

  • The organization can provide a ‘Letter of no objection or involvement’ to non-resident Canadians who want to adopt a child in India and are residing in a foreign country. This letter proves that the Canadian government approves of the adoption and will permit the adopted child to its boundaries. 
  • Some parents are eligible to get citizenship for their adopted child. They just need to contact the Consulate to determine whether their child will be granted Canadian citizenship. 
  • If the child isn’t granted Canadian citizenship solely based on their parents’ citizenship status, they can be sponsored by another Canadian citizen for permanent residence. 

Prospective parents are advised to reach out to the Canadian High Commission in New Delhi before they take any steps in the adoption process. It is a good idea to understand the adoption laws of both countries clearly before attempting to adopt. 

4. Marriages in India

Canadian citizens can marry in India to Indian citizens if they wish to. However, there are several things to keep in mind:

  • All marriages should be registered in India if it is happening in India, regardless of the citizenship status. Marriage can be registered under the Hindu Marriage Act or Special Marriage Act. 
  • The Indian Registrar of Marriage will require a letter from the High Commission of Canada in India to prove that the people involved are free to marry. 
  • Canadian law doesn’t require such proof and therefore cannot provide such a document. However, citizens can obtain a ‘Statement in lieu of Certificate of Non-impediment to marriage’ from the Consulate. This is generally accepted by the Indian authorities. 

You can obtain this certificate from the Consulate by requesting an appointment from your nearest Consulate General. 

5. Notarial Services

The Canadian Consulate General provides notarial services to Canadian citizens and a few non-Canadian citizens as well. These are offered by appointment only. The documents to be attested must be either in English or French or must have an official English or French translation. 

The Notarial Services offered include:

  • Providing a certified copy. 
  • Authentication or attestation of important or official documents. 
  • Witness signature on important documents. 

Make sure all of your documents are complete before you book an appointment with the consulate. You will sign all of the documents wherever your signature is required in front of the Consular Officer. 

6. Studying in Canada

7. Voting Aboard

Canadian citizens have the right to vote in Canadian elections as long as they remain citizens. You can exercise this right even if you are vacationing or living in India. The steps to take include:

  • Adding your name to the International Register for Electors
  • Completing the form to request a special ballot in time for the elections. You need to contact Elections Canada for this. 
  • Visiting the Canadian High Commission in New Delhi or a consulate near you. Make sure the consulate offers electoral services by calling ahead. Not all organizations will.
  • Cast your vote when it is time. The application for the special ballot should reach Elections Canada on the Tuesday before Elections Day by 6 PM ET. 
  • The completed ballot should reach Elections Canada before 6 PM ET on the election day.
